Key Bankruptcy Steps and Requirements
Certain legal steps are required for both a Chapter 7 and a Chapter 13 filing, although there are significant differences that we can readily explain. Here is a basic outline of what to expect:
- As soon as you retain us, we will start taking all calls from your creditors. This way, you can gain some immediate stress relief and start thinking more clearly about the future.
- We can often start working on your bankruptcy petition, but completing the petition will require you to gather key documents relevant to your assets and debts.
- Once we have all the information required and you can pay the court filing fee, along with attorney's fees according to the terms we have worked out together, you can proceed with required steps such as completing relatively simple debtor education and credit counseling.
- We will file your case with the bankruptcy court in Detroit. At this point, an automatic stay goes into effect which prevents creditors from calling or taking action against you.
- You will receive notice of a meeting of your creditors — typically to be held within 45 days of your filing. Your bankruptcy attorney, Mr. Lucido or Ms. Cicchelli, will appear with you.
- After another 60-90 days, during which creditors can — but typically do not — file objections in your case, you will receive either a discharge of your debts or approval of your Chapter 13 plan.
